In opening remarks, Irman Gusman reminded Indonesian achievement that won the overall champion at the Sea Games 2011 event. Another noteworthy achievement is the success of Indonesia in leading ASEAN. &#8220;Indonesia has successfully brought the ASEAN countries for the affirmation of a shared commitment to ensure real progress in realizing the 2015 ASEAN Community,&#8221; said Irman Gusman.</p>
<p>In addition to Indonesian achievements, Irman Gusman also noted the tragic and oppressive incidents, namely self-immolation incident of a student in front of the palace of the state, the Kutai Kartanegara bridge collapse case and the strong indications of human rights violations in Mesuji incidents</p>
<p><em>The Land reform</em> problems that often arise in the regions such as the Mesuji incident also becomes a concern for DPD RI. During this time, the leaders (political) are considered not strict enough to resolve conflicts in which resulting the mass rage in almost all areas. This was revealed by Farouk Mohammed, a member of the DPD from West Nusa Tenggara, in the opportunity as a guest speaker in DPD Dialog Perspective Indonesia with the theme &#8220;Mass Rage in the country, Source and Solutions&#8221;.</p>
<p>&#8220;Mass Rage is the result of the meeting of two worlds, politics and non-political, so we have to direct the solution to the power of the leader,&#8221; said Farouk in the Press Room DPD RI, the Parliament Complex. Senayan, Jakarta (03/02/12).</p>
<p>The cause of the mass rage, according to Ichsan Malik (Chairman of <em>Titian Perdamaian</em> Institute ), is a failure in reading the source of the problem, the dispute is not resolved so that it bears the tension and leads to violence. &#8220;The media, police, government, and NGOs should work together to resolve the conflict, but they fail to coordinate,&#8221; said this member of TPF Mesuji case.</p>
<p>From the cultural spectacles, humanist Arswendo Atmowiloto views the wrong process of identification which causes the mass rage. &#8220;In the cultural approach, we should put the communication first rather than violence. The reasons for the mass rage were sometimes not strong enough so it actually causing the forcing rage, &#8220;he said.</p>

			<content:encoded><![CDATA[<p>The House of Regional Representative of the Republic of Indonesia will invite Head of the Indonesian police and Head of the County police of Ambon to explain the riots in Ambon, Maluku. <p>The clash between residents that occurred in Ambon on Sunday (11 / 9) had killed three people, namely Jefry Edo Siahaan from Medan North Sumatera, Klivord Belebur and Darfin Saimen. At the time Jefry Edo’s body was returned to Medan, his family questioned the background of Jefry’s death to Parlindungan Purba. Parlindungan asked the police to explain the death of Jefry and to conduct an autopsy. &#8220;The absence of a letter of introduction was being questioned by the family, even if they willingly accept it&#8221;, said Parlindungan.</p>
<p>Meanwhile, John Pieris deplored the police for neglecting and are very slow in handling the riots, so that it killled 7 people. John also asked police to conduct an autopsy and ballistics tests on the Jeffery’s corpse to know what type of bullet that killed him. &#8220;If the bullets are from the security forces, the forces systematically engaged in it&#8221;, he said.</p>

The Bill is not used as a political vehicle for the team&#8217;s success (TS) a particular candidate in the regional election. The Community Organization Bill should also be based on the principle of Pancasila and the requirement on the establishment of Community Organization should also be tightened. This is intended to avoid social conflicts between communities that developed nowadays.</p>
<p>This was revealed in the report of Committee III DPD RI in a plenum to discuss the results of a working visit of the DPD RI member to each electoral district with a theme of the community organization bill and manufacture of Team Work. The hearing was led by Chairman of Committee III Hardi Selamat Hood, in 2<sup>nd</sup> floor, Building B DPD RI, the Parliament Complex, Senayan, Jakarta, (6/9).</p>
<p>The members’ working visit to each electoral district is aimed to raise aspirations and view of region as well as input on the the Bill. Absorption of aspiration is based on the duties and authority of the DPD in the field of legislation contained in Article 22D of the 1945 Constitution.</p>
<p>Based on Article 8 of the Community Organizations Bill that is proposed by the House of Representatives (DPR RI) to the President on July 21, 2011 allows people to form organizations. With only established by at least 3 (three) person of Indonesia citizen, community organizations can be obtained.</p>
<p>According to H. Lalu Supardan Kasiran, DPD member from West Nusa Tenggara Province the inclusion of such article must be strengthened with the requirements and specific criteria. The inclusion of these special requirements is to avoid social conflicts in society.</p>
<p>Hj. Rahmiyati Jahya, DPD RI member from the Province of Gorontalo said if today many community organizations have become successful teams in the election, &#8220;needs to be affirmed, there are rules for how organizations is formed, not used as a political tool to support one candidate in the election,&#8221; thought Rahmiyati.</p>
<p>While Sulistiyo, member of the DPDRI from Central Java Province argued about the need for transparency provisions funding for the foreign fund in the community organization bill. <p>Reading a Progress Report on Implementation Task of Committee I DPD in plenary session DPD at Nusantara V Building, Parliament Complex, Senayan, Jakarta, Friday (15 / 7), Eni has requested approval of the DPD Plenary Session to legalize the Village Bill into DPD products.</p>
<p>DPD Version of Village Bill becomes one of the initiatives proposed bill of Committee I DPD with the bill on Amendment of Act Number 43 Year 1999 on Amendment of Act Number 8 Year 1974 on the Fundamentals of Civil Service (Civil Service bill), and the Land Bill.</p>
<p>Settlement of the Village Bill as a follow-up of the previous period, has led to the improvement of academic texts and draft bill. Committee I DPD has an agreement on Academic Manuscript and Draft Bill on Village on June 28, 2011 that was harmonized by Bill Drafting Committee (PPUU) DPD.</p>
<p>&#8220;The completion of DPD version of the Village Bill is very important because one part of the revision of Act 32/2004 on Regional Government, following the Regional Head Election Bill (Pemilukada) and the Regional Government Bill which was approved some time ago,&#8221; said Eni.</p>
<p>Some of the main issues is DPD version of the Village Bill put village as &#8220;the small country&#8221;. &#8220;Small country here does not mean &#8216;there is a state within a state&#8217; but because the spirit of the village positioned on the front line, bottom, and the nearest community,&#8221; he explained.</p>
<p>In addition, rural settings based on the principle of recognition, the principle of delegation, and the principle of subsidiarity; recognize and preserve the history, socio-cultural, geographical, and rural resources; ensure the rights and opportunities of village to take its decision based on community initiatives; create the rural management that is participatory, responsible, accountable, open, and ensure equality for everyone.</p>
<p>DPD Version of Village Bill also gives confidence and opportunity to the village to develop initiatives and their potential, build assets and villagers access to natural resources, public services, and state budget to improve the quality of equitable community life, dividing the village into two typologies of diversity, namely the original village and self-government village; and the funding allocation of the village at least 5% of Budget Revenue and Expenditure (Budget).</p>
<p>Settlement of this Committee I DPD program is due to Team Work (timja) formation, among others, the Team Work of the Village Bill headed by Amang Syafruddin, the Team Work of the Civil Service Bill (Jack Jacob Ospara), the Team Work of Land Bill (Rahmat Shah), the Team Work of National Security Bill (Farouk Muhammad), the Team Work of Supervision Population Administration (Said Ahmad Fauzi Bachsin), the Team Work of Special Autonomy (Paulus Yohannes Summino), and the Team Work of the State Border (Ferry FX Tinggogoy).</p>
<p><strong>The Civil Service Bill</strong></p>
<p>Regarding to DPD version of Civil Service Bill, some of the main issues are to make the Civil Service Act as &#8220;the rules between&#8221; civil service regulations and other regulations, such as the Act on Regional Governance and Act on Freedom of Public Information; correct the ineffectiveness and inefficiency of rules that lead to deviations due to the implementation of the Civil Service Act, redefined and categorize state apparatus and its elements, making the Civil Service Act as an umbrella policy of civil service arrangements for sectoral laws also do not set it, and to unified legislation in the field of personnel policies.</p>
<p>Then, to protect civil servants (PNS) from a practical political interests through performance-based management (job competency standards, performance standards, performance assessment, reward and punishment, etc.) including sanctions for perpetrators of the practice of politicizing the bureaucracy; the establishment of the State Civil Service Commission (KKN), determination and affirmation of official employment adviser is the highest career officials (secretary-general, regional secretary, deputy ministers, deputy head of the region), and sanctions for officials who attract civil servants or bureaucracy into practical politics.</p>
<p>DPD version of Civil Service Bill also regulates the management of personnel and policy implementation of Act 43/1999 rules that civil servant coaching is a career in the closed state, so it is possible for displacement and promotion between ministries / institutions / provinces / counties / cities; civil servant is obliged to maintain the unity and integrity the nation. The government agency responsible for overseeing the implementation of policies in civil service management is the Ministry of Administrative Reform and Bureaucratic Reform (Kem PAN and RB), State Personnel Board (BKN), Institute of Public Administration (LAN), and the Civil Service Commission (KKS).</p>

The meeting, chaired by the Chairman of Commission XI I. Emir Moeis, was attended by representatives of the Committee IV DPD RI, the Minister of Finance, representatives of the Ministry of Interior, and the Ministry of Justice and Human Rights. This DIM bill contains 500 DIM with as many details as 176 fixed DIM, 73 new proposals, and 251 proposed changes. (saf)</p>

Committee I in the Public Hearing Meeting (RDPU) discussed subjects related to the material of Island Province Bill by inviting resource persons Maluku governor who also serves as Chairman of the Islands Provincial Cooperation Agency (Karel Albert Ralahalu) and Director General of Marine, Coastal and Small Islands of Ministry of Marine and Fisheries held in the DPD Building, Parliament Complex Senayan Jakarta, Monday (30/01/2012).</p>
<p>Karel Albert Ralahalu explained that the aquatic terrestrial area known its marine area is larger than the mainland tends to be isolated because there is no access to various fields, especially education, health, economic, political and social culture. “From the calculation of the General Allocation Fund (DAU) it counts only of territorial land area while the sea is not calculated,” said Karel, otherwise “consideration for the fishery results as in the islands obtain the same results with the continental areas”, he added.</p>
<p>Governor of Maluku had been initiated and designed the meeting of 7 (seven) Governors and Chairman of the Regional House of Representatives (DPRD) from the island provinces, i.e. Riau Island, Bangka Belitung Island, West Nusa Tenggara, East Nusa Tenggara, North Sulawesi, North Maluku and Maluku on August 19, 2005 in Ambon. On that occasion the Islands Provincial Intergovernmental Cooperation Forum was formed which has responsibility to formulate the calculation of national DAU by considering indicators of sea area, which is called the “DAU of Pangkal Pinang”. In 2007 the forum held a working meeting to prepare the Academic Paper and proposal of Amendment to Act No. 32 of 2004 on Regional Government. In 2008 they agreed the development of leading commodities with 7 (seven) Islands provinces such as seaweed, and the name of forum was changed into Islands Provincial Regional Intergovernmental Cooperation Agency to make its activities more operational. Islands Provincial Regional Intergovernmental Cooperation Agency was again changed into Cooperation Agency (BKS) of Islands Province in 2010.</p>
<p>The Academic Paper and Draft of Isles Bill are accomplished and agreed to be championed by DPD and submitted to the House of Representatives (DPR RI) that the Bill is a proposed bill of National Legislation Program (Prolegnas) year 2010-2014 as Bill of Special Treatment for Islands Province.</p>
<p>Act of Islands is considered important because sociologically islands have specific differences with other regions that have different characteristics so that the model of development must be different with the continental regions, “islands are late in the development of maritime infrastructure so that the people are isolated and have retardation in economic development and other fields,” explained the Governor.</p>
<p>At this Public Hearing Meeting, Committee I DPD agreed and provided further support for the Isles Bill to be validated soon.</p>

<p><strong></strong><strong>Jakarta, dpd.go.id</strong> – The House of Regional Representatives of the Republic of Indonesia (DPD RI) held the 9th plenary session of Session III Year 2011-2012, on Wednesday (01/02/12). Led by the Chairman of the DPD RI, Irman Gusman and was accompanied by Vice-Chairman I of the DPD RI, Laode Ida, the plenary that is located in Nusantara V MPR / DPD RI Building scheduled 2 (two) things, among others: 1. Ratification of the DPD RI decision; 2. Establishment of the Special Committee on Agrarian Conflicts and Natural Resources DPD RI.</p>
<p>Related to the ratification of the DPD RI decision, the Committee for Public Accountability (PAP) DPD RI argued about the importance of the effectiveness of supervision and law enforcement related to management of the state in the region. As spoken by the Vice Chairman of the PAP, Andika Hazrumy (DPD RI member from Banten Province) that the supervisory system in general has not been effective. This is indicated by the deviation between the practice and the findings of irregularities also between the recommendations and the follow up that allegedly influenced by various factors from both regulatory and managerial aspects as well as the system including institutional oversight.</p>
<p>&#8220;PAP needs to recommend their efforts to increase the effectiveness of supervision and law enforcement related to financial management of state in the region, among others: 1. State Financial Control; 2. Law Enforcement; 3. Management of State Finances; 4. Integrity System; 5. Regional Autonomy System and Administration System. Therefore, PAP DPD RI in the Plenary Meeting agreed to propose that the recommendations can be set into the DPD decision, &#8220;said Andika.</p>
<p>Then, the Committee IV DPD RI conveyed the DPD RI Decision Draft on Consideration of the DPD RI toward the Fit and Proper Test Results of BPK RI Candidates of 2012 that will be taken a decision in a plenary session of DPD RI.</p>
<p>&#8220;Considering that there are 2 (two) members of the BPK that ended his tenure; therefore, it would require the selection of members of the BPK. Mandate of Article 2F paragraph (1) Constitution of 1945 states that members of BPK RI elected by the DPR RI by noticing the DPD consideration and was inaugurated by the President, &#8220;said Litha Brent (DPD RI member from the province of Central Sulawesi) as Vice Chairman of Committee IV.</p>
<p>Litha Brent explained that the assessment is done by mapping criteria of competency (<em>competence</em>), namely education and the experience also suitability criteria (<em>acceptability</em>), namely integrity and leadership candidates for the BPK RI. &#8220;Based on the results of such mapping, the DPD RI recommends to the DPR RI 17 (seventeen) names of the candidate members of BPK RI included in the quadrant with high suitability value and the value of high competence,&#8221; said Litha Brent.</p>
<p>Furthermore, associated with the rampant cases of land dispute that occurred in the homeland, threfore the DPD RI deems necessary to establish the Special Committee on Agrarian Conflicts and Natural Resources DPD RI. &#8220;Agrarian Conflict and the Special Committee of Natural Resources DPD RI consists of a maximum 15 (fifteen) people consisting of 6 (six) people from the Committee I, 3 (three) people from Committee II, 2 (two) people of Committee III, 2 (two) people of Committee IV, 1 (one) person of PPUU and 1 (one) person of the PAP, &#8220;said Irman Gusman while knocking the hammer that signed the verdict.</p>
