BAP Follows Up Aspiration of Lampung Residents Related to Land Conflict

Jakarta, dpd.go.id - There are three (3) community aspirations followed by BAP namely land conflicts between Pidada-Panjang Lampung residents with PT.Pelindo II Cabang Panjang, land case of former land of Hak Erfpacht NV.Way Halim Sumatera Rubber and Coffe Estate between the residents of Way Dadi, Way Dadi Baru and KORPRI Jaya, Sukarame Subdistrict, Bandar Lampung City with Lampung Provincial Government, and land problems between the residents of Sawah Brebes Urban Village Bandarlampung and Branti Village, South Lampung Regency with PT. KAI (Persero).

Senator Lampung, Andi Surya who escorted this aspiration said for land issues with PT. KAI (Persero), there has been formed an analysis team and conducted work meeting in mediation of BAP DPD RI dated August 25, 2017 at the Office of Bandar Lampung Mayor with the unclear status of land on the edge of railway tracks and no concrete administration, meaning the land is classified as land abandoned, in addition it has also been concretely concluded and legally reviewed that grondkaart can not be declared as the base of rights, so it can not be accounted for. With regard to that, we asked the City Government of Bandar Lampung to verify with BPN and the residents so the land could soon be certified.

"Meanwhile, land conflicts between Pidada-Panjang Lampung residents with PT.Pelindo II and land conflicts between Way Dadi residents and Lampung Provincial Government are about the residents who have occupied the land for more than 60 years, but the HPL (management rights) that disturb public order was later emerged stating the land is already certified, we hope that this problem will be resolved soon and the people get their life rights, "pleaded Andi Surya in the hearing led by Abdul Gafar Usman, Chairman of BAP accompanied by Ahmad Sadeli Karim and Novita Anakotta Vice Chairmen of BAP together with members of BAP in Building B DPD RI Senayan-Jakarta, Wednesday (31/01/2018).

The hearing invited many stakeholders including Bandarlampung City Local Government, Bandar Lampung Police, Ministry of Finance, Ministry of Agriculture and Spatial Planning (ATR) / National Land Agency (BPN), PT. Pelindo II, and PT. KAI for mediating community aspirations related to land issues.

Secretary General of the Ministry of ATR / Head of BPN, M. Noor Marzuki stated that basically there have been settlement steps for the problem. However, land settlement on individual rights with rights registered as BMN is different. It must go through several stages, and decided by the court.  The land is related to government assets then the decision is made by the asset manager.

Meanwhile, Director General of State Property Ministry of Finance, Isa Rachmatarwata explained the status of land that became the problem between the residents of Pidada-Panjang Lampung with PT.Pelindo II Cabang Panjang and the land that became the problem between the people of Sawah Brebes Urban Village Bandarlampung and Branti Village, South Lampung Regency with PT. KAI (Persero) is not a land listed as State Property (BMN) so the land issues can be solved with PT.KAI and PT.Pelindo II. While for the status of Way Dadi community residents, Way Dadi Baru and KORPRI Jaya Regency Sukarame Bandar Lampung recorded as an asset of the Regional Government of Lampung Province.

At the end of the hearing, the Leadership concluded that from the explanation of two institutions, the status of the land occupied by Pidada-Panjang Lampung residents, and the residents of Sawah Brebes urban village Bandarlampung and Branti Village, South Lampung has no problems, whereas for land issues related to local government, they can coordinate with the residents.

BPN together with the Government of Lampung and the residents should conduct administrative verification and procedure while the Ministry of Finance, Ministry of Agriculture and Spatial Planning (ATR) / Head of National Land Agency should monitor and supervise, and Senator Andi Surya will continue to guard the follow-up. The hearing requested the Mayor of Bandar Lampung and the Governor of Lampung to be proactive in solving this problem.
