The Plenum of PPUU: The Importance Of Disaster Status Determination Conditions for the Sake of Legal Certainty


Jakarta, dpd.go.id - In order to inventory the materials Bill on Amendments to Act No. 24 Year 2007 on Disaster Management, Bill Drafting Committee (PPUU) of the House of Regional Representative of the Republic of Indonesia (DPD RI) held a Focus Group Discussion (FGD) in three (3) provinces of Riau Islands, Yogyakarta and West Nusa Tenggara.

"The agenda today is to listen to the report on the material inventory on Amendments Bill to the Act No. 24 Year 2007 on Disaster Management," says Baiq Diyah Ratu Ganefi, S.H., Vice chairwoman of PPUU, while opening the meeting which was held in Meeting Room PPUU, Building B DPD RI, 3rd floor, Parliament Complex Senayan Jakarta, Wednesday (08/03/2017).

Venturing the report, H. Habib Hamid Abdullah, SH, MH, Senator of South Kalimantan says that there are some problems that occur in the Riau Island, among other is there has been no guidelineson the establishment of a regional disaster status from the center or derivative Act No. 24 Year 2007 and weak coordination among SKPD in the regions.

"Presidential Determination of Status and Level Disaster according to the mandate of Article 7 of Act 24 Year 2007 has not been issued, whereas it has been discussed since 2009, as a result the government often hesitate to set the status of a disaster, such as smoke from forest fires in Sumatera and Kalimantan, which extends to neighboring countries," says Habib.

Meanwhile, FGD DI Yogyakarta Team represented by Dra. Hj. Eni Khairani, M.Sc., (senator of Bengkulu) more emphasis on the notion of disaster. Eni says that the current understanding of disasters can bring out the double meaning and implications for the harm in handling and politicization of the incident based on the interests and sacrificing the interests of the people.

"The definition of a disaster need to use terminology that apply globally, for example, the definition of the UN-ISDR or has a similar meaning substantially," says Eni.

FGD results of these three areas are equally concluded that there is a need for improvements to some of the provisions to provide legal certainty to the implementation of disaster management, especially in terms of the determination of the disaster status.

Todays meeting also reported the results of the Joint Working Visits between PPUU with the Special Committee of Archipelago Concept DPR related to the inventory issues in discussing the bill with DPR and the Government in Manado, South Sulawesi. (Ram)
