The Needs for Clarity on the Law of State Territory
Jakarta, dpd.go.id – Territory in the concept of International law and the law of the sea is a place where the state has sovereignty. In Indonesia, those territories are consisting of air, land, sea, seabed and all the wealth in it. “Especially for marine areas, Indonesia has experienced remarkable expansion which increased to 60 times since the proclamation era to around 6 jt km ² while the land area is relatively fixed”, explains Prof. Hasyim Djalal, an expert on International maritime law.
According to Hasym, the addition of the area or territory can occur naturally or by purchasing other areas and should have gained recognition in International law. As for the economic zone, it is not the territory of Indonesia but Indonesia has sovereignty over natural wealth that was found there, as a result of the expansion the other countries nowadays can not take the wealth in it anymore. In the Public Hearings Meeting of Committee I, on Tuesday (17/01/2012), Hasyim hoped that one day when Indonesia are able to explore the mineral resources of the vast ocean away from Indonesia like other Asian countries like china and japan.
In terms of security, Jaleswari Pramodawardhani spoke. There are two forms of threat in the border region, namely the threat from countries such as the violation of borders and non-state threats such as piracy. “Threats like this due to lack of care in the area”, he said. “I think what we need to do is not just guarded by using military force but also the non-military force,” added the military observers of the Indonesian Institute of Sciences (LIPI). The need for clarity of the central government and local authorities in Law Number 43 Year 2008 greatly help to maintain security and border regions of our country.
