Since the Mine Royalty is Small, Mining Regulation needs to be Reassessed

Jakarta, dpd.go.id – Indonesia has an abundant wealth of natural resources, but unfortunately it has not been managed and used properly, such as minerals, oil and gas. According to Kurtubi’s view, the contribution of mining revenues from both oil and non-oil and gas are relatively small so that the government intends to limit the production of these natural resources. “There seems to be an error in the management of our national mine”, he explained on the 14th Public Hearing of Mining Special Committee (RDPU), Monday (30/01/2012).

In addition, this mining and petroleum experts also said that the system of work contract is not used anymore because it is derived from the mining act of colonial era, even mineral and coal (Mining) Act adds to the chaotic of general mines in Indonesia because it is not in accordance with the constitution. The obscurity of owner and manager of the mine were also seen in article 33 paragraph 3 of the 1945 Constitution, “for which I propose to add the word ‘controlled and owned’ in the article so that the meaning is not ambiguous,” he continued.

Marwan Batubara, a mining analyst and former Member of the DPD RI in 2004-2009 period said, “The exploitation of natural resources and state control has not been able to prosper the people. This is because state revenues from the mining sector are not optimal due to the lack of role of state-owned enterprises (BUMN) and regional-owned enterprises (BUMD)”, he said. “Natural resources and state-owned enterprises should be a pillar of national economy, therefore the state-owned enterprises and regional-owned enterprises must enhance the role and execute the mandate of the constitution”, he hoped.

Located at the Parliament Complex, Senayan Jakarta, Erwiza Erman invites more to make innovations in the mining aspects as a whole. On that occasion he described 3 things to watch out for the government, “The government should have an exploited mine area database, the mine needs to be managed as part of the industry to produce added-value and exploitation of mining must ensure the sustainability of social, cultural and environment so there is no conflict”, said this LIPI investigators in short.

“The existence of competition or rivalry can lead to progress in the mining sector revenues as they will continue to improve the management system of the mine”, said Sammy Hamzah closed the discussion meeting. Good and competent human resources are also influential in the advancement of our national mining product.

At the end, the DPD is expected to play an active role in the task of supervision and coordination between central and regional governments related to mining because existing regulations are not run by the Parliament and Government.
