Jakarta, dpd.go.id – The fit and proper test for prospective members of BPK RI (The Audit Board of the Republic of Indonesia) being held in Committee IV DPD will expire today, Wednesday (01.25.12). Encountered when meeting, Chairman of Committee IV DPD, Cholid Mahmud (the Senator of D.I. Yogyakarta province) states that the fit and proper test is the constitutional duty of the DPD. Through the selection mechanism that is run by the Committee IV, expected the best candidates as DPD’s recommendation to the House of Representatives.

Asked about the possibility of DPD recommendations are not noticed by the House of Representatives, Cholid says it’s a different matter outside of the fit and proper test itself. But it related to the House of Representatives authority. However, if the recommendations are ignored or candidates are chosen outside the DPD recommendation, then the DPD RI will do the dispute of authority by first asking a fatwa to the Constitutional Court (MK).

“The Act stated that the House will do the election of BPK members by taking into the DPD consideration. We interpret (sentence) “by taking into consideration of the DPD” will bring a certain impact. But in fact the House had never vote for a candidate in accordance with the consideration of the DPD, “said Cholid.

Law number 27 Year 2009 on the MPR, DPR, DPD and the DPRD, Article 170 and Article 171, as well as article 14 of Law no. 15 Year 2006 on BPK RI, mentioned that the House elects members of the BPK by taking into consideration the DPD. DPD interpret that consideration is the space for the Parliament to determine the elected candidate. On the other hand the House defines consideration as things to consider but not be selected. With this different interpretation, the DPD through plenary session had decided to ask for a fatwa, if consideration of the DPD is not considered by the House.

As reported previously, there are currently 35 people who follow fit and proper test process for prospective members of BPK. Of all candidates, the Committee IV DPD asked to submit two names to the House as consideration.
