Najamuddin Lawing: “Legislation as the Living Law in the Community”
Jakarta, dpd.go.id – Legislation is expected to bring a very deep sense of justice for Community.It is said to include a “living law” or law that live amongst the Community. It is delivered by Najamuddin Lawing, Member of the Assembly Law and Human Rights Chairman of Muhammadiyah, on the Public Hearings Committee III in views and opinions of Bills on Public Organization on Monday (3/10/2011) at the DPD Building, Senayan – Jakarta.
In the formulation of Draft Legislation (Bill) there are several points of the spotlight. First the word “local wisdom” needs to be explained in a comprehensive manner. According to Najamuddin, although the word is already the language of the political elite, it is not necessarily understood to local regulation or the lower levels. “Not necessarily the people who sit in the Level I/ Level II of Regional of Representative (DPRD) understand the meaning of local wisdom,” he explained.
Another thing that is highlighted is the chapter XV on control. Najamuddin proposed to held harmonizing or adjustments of Article 44 to Article 1 act (2) point (k) and (l) concerning the settlement of disputes and internal oversight mechanisms. He suggested that this should be explained because the explanation has not been specified that the dispute of settlement mechanism was like what. “This is important because it has not only the political nuances but also the law,” he asserted
Furthermore, on Chapter XVI, Najamuddin argued that the dispute resolution organizations in section 49 must be in harmony with article 52 act (6), (7) and (8). Due to the efforts of law in Article 49 act (3) only at the appellate level, “So there is confusion there,” he explained. While the article 52 of law efforts ended in the Supreme Court. “Well, this should also be examined,” he concluded. (and)
