Draft Bill of Amendments on Law No. 39/2004: Committee III carries Three Changes of Issues

Jakarta, dpd.go.id – Draft Bill of Amendments on Law No. 39/2004 will be focused on increasing regional involvement in the placement and protection of migrant workers (TKI). It is delivered by Fitriani Ahlan Sjarif, Expert Team Member of Draft Bill of Amendments on Law No. 39/2004, in the building of DPD RI – Senayan, Wednesday (05/10/2011).

Team of Experts, chaired by prof. Hikmahanto Juwana, Professor of International Law University of Indonesia, is carrying three issues related to definition of changes, the granting of authority to regional and institutional change.

Fitriani explained that in this bill is also set of non-workers such as independent workers and Children’s Crew Ship (ABK). “We still feel that the migrant workers who depart on their own or indeed the personal initiative of individuals have not signed into the old law,” she explained.

The next thing that is highlighted on the Mobilization Permit (SIP) is where the authority to grant and revocation of the SIP should be given to the area. Meanwhile, the region is also given the authority to provide labor market information, provide education and training as well as a place of health and psychological examinations.

The Academic Manuscript also mentioned the need to establish an independent national commission in charge of protecting its workers.

Fitriani also explained that the draft bill are based on research compiled by a team of experts since december 2010. “This bill has been made also based on field research in West Nusa Tenggara, East Java, and other areas in Indonesia,” he explained. (And / af)
