Jakarta, dpd.go.id – Expert Team of Committee II DPD RI on Oil and Gas reported a progress report on the Oil and Gas bill, prior to the implementation of finalization on the 3rd to 5th of October, 2011. Arfandi of the Expert Team reports “a few additions in academic texts about State Owned Legal Entity (BHMN) and State Owned Enterprises (BUMN), the Golden Share (GS), Indonesian Partisipant (IP), Royalty and Revenue Sharing,” he said in a working meeting of Committee II DPD RI on Oil and Gas, Building B, DPD RI, Senayan, Jakarta, Wednesday (28/09/2011).

The Working Team was debating on the status of Executive Agency for Upstream Oil and Gas (BP Migas) and Regulatory Agency for Downstream Oil and Gas (BPH Migas) if it is still State Owned Legal Entity (BHMN) or converted into State Owned Enterprises (BUMN). In the Law No.22 of 2001 concerning oil and gas, BP Oil and Gas is an Executive Agency for Upstream Oil and Gas, and BPH Oil and Gas as Regulatory Agency for Downstream Oil and Gas. Executive Agency for Upstream Oil and Gas (BP Migas) and Regulatory Agency for Downstream Oil and Gas (BPH Migas) have a status as BHMN according to its function as a supervisor, the ideal status is BHMN, but BHMN BP Migas not have Assembly Trustees (MWA), which functions as a supervision of the commissioner in the state.

Responding to the debate, Djan Farid DPD members from DKI Jakarta said “we should not change the status of Executive Agency for Upstream Oil and Gas (BP Migas), but refine it, as if adding Assembly Trustees if it is perfected, I agree”, he said.

The Working Team decided on the implementing agencies will be discussed further and deeper on the finalization of the written record. While the proposal on GS, IP and Royalty removed and more focused on Revenue Sharing (DBH).
