Legal Mafia and Anti-Corruption Problem
Jakarta, dpd.go.id – REFORMATION, besides bringing a change has also led Indonesia to the era of information disclosure. Including the fact of the rampant corruption that has so far been a legal mafia circle. That conclusion was conveyed by Irman Putra Sidin in State Dialogue entitled “Legal Mafia becomes Rampant, What Is the Solution?” in the DPD building, Parliament Complex Senayan, Jakarta (07/27/2011).
Further Irman explained who should be responsible for this legal mafia. According to him, the President and the Commission of Anti-Corruption (KPK) are the most responsible parties in combating mafia law. It is because the President in his capacity as supreme head of the police and prosecutors, while KPK as a specialized agency mandated to handle corruption. “The question is, there are many agencies deal with the legal mafia, the police, judiciary, KPK and even Task Force for Legal Mafia formed by the president, but why the mafia still exists?” said the expert in Constitutional Law of UI.
In addition, the practice of legal mafia continues for our civil and criminal law [Penal Code (KUHAP) and Civil Code (KUHP)] still adhere the legacy of Dutch. The principle of colonial rule implies that the Netherlands was never guilty. The current context is government, including prosecutors and judges are always right and cannot be prosecuted. “As long as the Penal Code and the Civil Code have not been changed, then the mafia will continue to exist,” said Nudirman Munir (Member of Commission III House of Representatives/Golkar faction)
The weakness of law enforcement which is sharp downward (the people), but is blunt upward (government), further enriches the practice of legal and corruption mafia. According to John Pieris (Chairman of Committee IV DPD RI), there are at least two motives of corruption, i.e. corruption by need and corruption by Greed. “These two motives of corruption are currently undermining our country’s resources; anyone can be the person either central officials or local officials, even the people can enliven” closed the senator from Maluku.
