Special Chapter is Required on the Role of Region in the Bill on Oil and Gas
Committee II DPD RI held a Public Hearing (RDPU) in order to encompass aspiration and inventory the problem of proposal of the initiative Draft on Oil and Gas. Meeting attended by Communication Forum on Oil and Gas Producing Region (FKDPM) and Indonesian Oil and Gas Society (MMGI) was held in Committee II DPD RI meeting room, B Building DPD RI, Senayan Jakarta, Tuesday, (31/5/11).
Law on Oil and Gas has not given authority to the region as oil and gas producing region, “Law No. 22 of 2001 on Oil and Gas has not or not reflect a division, moreover none of the chapter or article which authorizes the authority or rights to regions” said Mulyana Sukardi, MSc. Executive Director of FKDPM. “This is the cord, reason why we do struggle for this problem,” he said.
Similar opinion was also conveyed by Drs. H. Surya Djahisa, MSi. (Region Secretary of Langkat Region), there is discrepancy on region authority. “In the later revised legislation is expected local government authority, included in licensing and supervision because local government should know what will be implemented in the region.” he said.
On this occasion FKDPM proposes some input including a special chapter on the role of regions with substance; arrangement of revenue-sharing (DBH) and bonuses include funds from bonuses received by the central government relating to production sharing contracts (PSC); Corporate Social Responsibility (CSR); specifically oil and gas companies are required to conduct environmental and community development in the form of activity, physical facilities and infrastructure, or empowerment of local business and labor that is not in the form of cash fund; prioritizing domestic resources; direct access to information such as central government should ensure transparency of data used in determining revenue-sharing with local government; to get the maximum oil and gas production in the concerned regions.
Chairman of Committee II DPD RI, Ir. H. Bambang Susilo, MM., reminded that should not only focus on Revenue-Sharing (DBH) but also other matter relating to oil and gas in the region. “Do not contented to revenue-sharing only but also propose to central government to open new fields” he said.
In this meeting, Chairwoman of Working Team in the Bill on Oil and Gas, Intsiawati Ayus, SH, MH, said that the inputs from FKDPM and MMGI will become the new proposals and additions in the body of law.
