Solution for Indonesian Migrant Workers (TKI): Provide Full Protection

Committee III DPD RI held a meeting on Tuesday (07/06/11) in Committee III Meeting Room on 2nd floor Building B DPD RI Jakarta. Meetings led by Istibsyaroh (Chairwoman of Committee III DPD RI) had the agenda of DPD RI Academic Manuscript Bill on the amendment of Law No. 39 Year 2004 on Placement and Protection of Migrant Workers in Foreign Affairs by Team of Experts. DPD RI’s Academic Drafting Team for the bill which was also present at the meeting were Prof. Hikmahanto Juwana, Prof. Lalu Husni, Devi Rahayu, Anis Hidayah, and M. Ajisatria Suleiman.

The Problems of TKI (Indonesian Migrant Workers), which have never ended, such as molestation, rape and other violent acts, become the attention and concerns of Committee III DPD RI so it moves them to file the Amendment of Law No. 39 Year 2004. With these changes, TKI are expected to be able to get proper protection and treatment since staying in Indonesia to working abroad and later returned to Indonesia. In that Academic Manuscript, it was listed several things that are considered to give greater protection to TKI, so that the previous problems will not happen again, including rules for BNPPTKI (National Agency for Placement and Protection of Indonesian Manpower) and PPTKIS (Private employment Company in Indonesia).

It would be better if sending TKI abroad can be limited, reduced and eventually discontinued. That hope was dilivered by Sulistyo, senator from Central Java Province. However that hope seems difficult to be met, considering the insufficient jobs in the country. “Our government cannot provide jobs that can enable the workers to stay in Indonesia,” Hikmahanto conveyed. “Because the delivery of workers currently cannot be avoided, then the government should provide real protection to them,” Hikmahanto added.

Then, in terms of regional role on TKI, Lalu Husni proposed that PPTKIS authority should be reduced so that the socialization and information held by local workers. “We can form a regional placement agency for TKI that can coordinate job, language, and customs training. If their ability is feasible, then we send them to PPTKIS,” Lalu Husni explained. Finally, the forum also hopes for the future, Indonesia can send professional or formal employments, not non-formal TKI such as domestic helpers or factory workers.
