Fifth Amendment of the 1945 Constitution: Opportunities to Improve Nation
The 1945 Constitution has been revised four times, but it is still not enough to overcome the problems of Indonesia. There are so many complicated problems that the fifth amendment of the 1945 Constitution is considered urgent. That was delivered by Suharyadi (member of Advisory Council of Indonesian Rectors Forum) in the State Dialogue of DPD RI themed “The Urgency of the Fifth Amendment of the 1945 Constitution” held at the Press Room DPD RI, on Wednesday (8/6/11). In fact, Indonesian Rectors Forum (FRI) has created a special working group of the fifth amendment of the 1945 Constitution. According to him, in the fourth amendment, there are still many things that need to be perfected. “Substantially, there are several things that must be corrected,” said Suharyadi.
The same opinion was also delivered by Yonny Kusmaryono, Vice Rector of IPB, who expressed its support to the FRI on the need for the fifth amendment of the 1945 Constitution. The changes are expected to bring Indonesia into a democratic, just, and prosperous nation.
The hope of better Indonesia through the fifth amendment of the 1945 Constitution was also expressed by media practitioners, Don Bosco Salamun. “The fifth amendment of the 1945 Constitution is a must,” said Don Bosco. In addition, to achieve a better Indonesia, Don Bosco suggested the strengthening of public participation to conduct oversight of state enforcement. Public participation is a medium for maturing society. A mature society would be able to give rewards and punishments when the state system was not effective. The high number of abstainer is one form of “punishments” from public against political parties.
The fifth amendment of the 1945 Constitution might be a solution, but there is no guarantee that it will make Indonesia better. That is opinion of Zainal A. Mochtar, Lecturer of Faculty of Law, Gadjah Mada University. “I consider changes in the fifth amendment of the 1945 Constitution is an opportunity that must be taken, we must dare to go and change,” said Zainal. According to Zainal, another important thing to do is to summarize and tidy up the commission which is currently very large. “Next, we need to strengthen regions, form a healthy parliament, impose a pure presidential system, and realize the well checks and balances,” Zainal added.
