DPD: The Constitution Needs to be Refined

The House of Regional Representative of the Republic of Indonesia realized that our state constitution still have many fundamental weaknesses that require to be refined. Therefore, DPD RI held a national workshop entitled “Urgency the Fifth Amendment of the 1945 Constitution: Consolidation of Democracy and National Identity”. The event took place at the Nusantara IV Building, Parliament Complex, Senayan Jakarta, Tuesday (28/06).

In the event, Vice Chairwoman of DPD, GKR Hemas opened the workshop as well as launched a website www.perubahankelimauud1945.com. The website displays information and activities of the Group of DPD in the Assembly, it also contains draft of Fifth Amendment of the 1945 Constitution which can be downloaded to be read, criticized and given feedback by the community. “Community participation is essential in order to enrich the draft of the Fifth Amendment of the 1945 Constitution because it essentially belongs to the people”, said GKR Hemas.

Chairman of the Group of DPD in the Assembly, Bambang Soeroso said the constitution improvement is very important, in order to be a living and working constitution in line with the development of civilization and society. The 1945 Constitution has undergone four stages of change, Bambang said, but there are still empty spaces in the mechanism rules of relationship between institutions and branches of state power. “The actualization of the nation noble values ​​that are reflected through a complete understanding of Pancasila, the 1945 Constitution, and Unity in Diversity, and Unitary Republic of Indonesia increasingly reduced,” Bambang explained.

Bambang revealed that for about a decade, people feel an increase in welfare as mandated by the preambule of the 1945 Constitution. “People are still facing the empirical realities which in essence are the impact of the problems facing the nation,” said Bambang.

Through the support and active involvement of prominent academics from 75 universities and experts team, the Group of DPD in Assembly had have strategic issues to put into the formulation of the Fifth Amendment of the 1945 Constitution. The National Workshop of Group of DPD in the Assembly is intended to obtain national consensus on the need of changes to the 1945 Constitution, in order to make the arrangement of the political system and state administration towards a more ideal and effective. “In addition, the National Workshop as well as an enrichment moment over material proposal of the Fifth Amendment of the 1945 Constitution that has been crystallized by DPD RI based on the aspirations of the Indonesian community in various areas,” said Bambang.

Vice Chairman of the Assembly, Hajriyanto Tohari criticized a number of things in 1945 Constitution which include a lack of emphasis on the ideological aspects as set forth in the preamble of the 1945 Constitution, matters relating to the concept and implementation of the presidential system and the checks and balances among state institutions, accountability of state institutions especially the president, and long-term national development that still unclear. “Besides, many legislation rules which are not functioning properly and coherent with the 1945 Constitution,” said Hajriyanto.

Hajriyanto said that in several discussions with people in the region, it appeared a lot of questions from the public about the problem of the Fifth Amendment. The question that arose was about the President. “In the past the President was responsible to the Assembly, now after the president is directly elected by the people then presidential accountability mechanisms are not set in our constitution,” explained Hajriyanto.

Principles of the proposal of Fifth Amendment of the 1945 Constitution include: Strengthening the Presidential system, Strengthening the Legislative Institutions, Strengthening the Regional Autonomy, Individual Presidential Candidate, Sorting the General Election and Local Election, Previlegiatum Forum, Optimizing the Constitutional Court role, Adding the article of Human Rights, Adding the chapter of Commission state, Focusing on the Chapter of Education and the Economy.

The national workshop resulted national consensus as follows:

1)      The Fifth Amendment of the 1945 Constitution is the crystallization of the various aspirations of all communities throughout Indonesia, as the owner of sovereignty, who wants the realignment of our constitutional order. As the crystallization of the ideals and common will, the fifth amendment of the 1945 Constitution needs to be fought together with the full dignity in order to serve the nation’s agenda through the Assembly session in 2011;

2)      Full support of all the people of Indonesia to the fifth amendment of the 1945 Constitution solely to strengthen the constitutional order, the life of national and state fairly, and strengthening the unitary Republic of Indonesia in order to realize the ideals and goals of state to achieve the people welfare;

3)      Proposed of the fifth amendment of the 1945 Constitution needs to be voiced widely, civilized and dignified, as a manifestation of the shared responsibility of people of Indonesia, from Sabang to Merauke, in realizing the ideals of nation and state;

4)      The basic idea of ​​the fifth amendment of the 1945 Constitution should ideally be designed to avoid the compromises, which potentially weakens the mechanism of state administration;

5)      Fifth Amendment of the 1945 Constitution should be based on the spirit and values ​​of mutual cooperation, so that the 1945 Constitution truly reflects the identity of the Indonesian nation.
