Djoko Kirmanto: Unable to Ensure if the Law no. 38 of 2004 about Road Needs to be Revised
The law No. 38 of 2004 about Road is set by considering several things, including the development of regional autonomy, challenges of global competition, and demands of increased community role in the implementation of the road that led the Law No. 13 of 1980 about Road to be no longer appropriate as the legal basis for road setting.
However in its development, the Committee II DPD RI deems necessary to do the revisions to Law No. 38 of 2004 on Road. Therefore, a working meeting is conducted between the Working Team Committee II DPD RI with the Ministry of Public Works (PU). Working meeting held in Meeting Room of Committee II 3rd floor, Building B DPD RI, Parliament Complex in Senayan, Jakarta (13 / 6) Monday afternoon.
In his presentation, Djoko Kirmanto as the minister of Public Works said that in accordance with the mandate of Law No. 38 of 2004 and PP No. 34 of 2006 on Road, the ministry of Public Works has completed the implementation of regulations, among others:
1. Ministerial Decree of PU No. 630/KPTS/M/2009 on Determination of Road Segments in Primary Road Network according to its Function as Arterial Road and Collector Road 1, issued on December 31st, 2009.
2. Ministerial Decree of PU No. 631/KPTS/M/2009 on Stipulation of Road Segments according to its status as a national road, set on December 31st, 2009.
3. Ministerial Regulation of PU No. 11/PRT/M/2010 on Procedures and Requirements for road-function that is set on 19th, October 2010.
4. Ministerial Decree of PU No. 567/KPTS/M/2009 on the General Plan of the National Road Network that is set on November 10th, 2010.
5. Ministerial Regulation of PU No. 20/PRT/M/2010 on Guidelines for Utilization and Use of road sections, set on December 29th, 2010.
6. Furthermore, it is currently being prepared the draft of Ministerial Regulation of PU on Minimum Service Standards, Road Maintenance, Technical Requirements for Roads, Public Roles in TURBINBANGWAS, Research, Assessment in the Operation of Roads and also the Draft of Public Works (PU) Ministerial Regulation on Financing Assistance to local governments in road management.
Associated with the exposure that has been submitted by Djoko Kirmanto, Chairman of the Working Team on Road Bill, Gusti Farid asked whether the Ministry of Public Works agree or not for the revision of Law No. 38 of 2004.
Responding to these questions, Djoko Kirmanto answered in bias, “in relation to what we have to say, I can not say if we agree or reject, but all of it can still be discussed, then we give the views whether it is necessary for improvements or not. If it is needed we do not mind, we just need to believe it together, “said Djoko closing the conversation. (Dew)
