Darmayanti Lubis: “Government has not Consistently Implemented the Law No. 39/2004″

Placement of Indonesian migrant workers (TKI) in Korea has not met the formation of availability of labor market in Korea. This was conveyed by senator from North Sumatra Province, Darmayanti Lubis, at the Plenary Session of Oversight Report related to Law No. 39 Year 2004 on Placement and Protection of TKI in Foreign Countries on Wednesday (15/6/11) at DPD building Parliament Complex, Senayan - Jakarta.

Darmayanti Lubis revealed that this is due to a lack of ability in terms of language; lack of skills and needs as well as the most important thing is the slow procedure in the homeland. I think the most important is our oversight towards BNP2TKI” she said.

TKI in Korea face vary diverse problems. Skills in Korean and English are obstacles for TKI. Other findings are TKIs get the Standard Labor Contract (SLC) just at the time they are on the plane; even they get it after arriving in Korea. “So they do not know their rights and obligations.” Darmayanti explained.

She further said that many TKIs experienced stress due to heavy workload, bad air, and sometimes they do not get salary. The other problems are inappropriate salary, unpaid insurance, and leaving work without permission from the employer because of friend’s inducement.

Darmayanti assessed that Government has not been consistent in implementing the legislation on the placement and protection of TKI. “Government has not implemented Law No. 39 Year 2004 consistently, particularly Article 5, paragraph 1, 6, 7, 8 and so on,” She ended.
