Jakarta, dpd.go.id – As a Country which recognizes the sovereignty on the hands of the People, the Government is still considered less in providing community participation for public policy formulation process. However, the question arises if the Bill on Public Participation can be realized, will the communities able to undergo this role?

That is one important point that emerged in the Public Hearing Meeting (RDPU) Timja II PPUU DPD regarding the Draft Law on Public Participation by inviting Prof. Dr. Made Subawa, SH., MS (Professor of Constitutional Law) in Meeting Room PPUU DPD, Parliament Complex Senayan, Jakarta, Thursday (6/23/11).

In his explanation, Hestu Cipto Handoyo, as PPUU expert staff, stated that the culture of Indonesia is an agrarian culture, which means still can not build community participation, in contrast to participants’ culture where people already feel as part of political actors.

The solution, Hestu sees the need of two (2) paradigm in the context of drafting the bill on Community Participation which are first codification, the collection of symptoms that already exist in society and poured into legal norms or formulas given law; second is the modification or engineering, “what I’m saying is this bill should have a pattern of engineering from people whose culture is Kaula, Agriculture, to Participants toward maritime culture, “he explained.

Hestu also asserted the bill will need to have a community mapping. Similar to Paulus (DPD Senator from Papua) suggestion who wants Cluster for society, “we must dare to make Clusterization of relevant community.” He emphasized the importance of Clusterization in order to clarify that not all elements of society can participate in the process of formulating public policy.

The meeting chaired by I wayan Sudirta (DPD Senator from Bali) also discussed the concept of academic Draft presented clearly by the expert, Made Subawa.
