Community Health Insurance as the Mandate of Law 40/2004 and the 1945 Constitution
Provision of health care facilities in the form of Community Health Insurance (Jamkesmas) is a mandate of the Constitution of the Republic of Indonesia Year 1945 and Law No. 40 of 2004 on National Social Security System that should be done by the government and its staffs. Local governments (provinces, districts, cities) are welcome to provide health care facilities in the form of Jamkesmas area, so that all Indonesian citizens can obtain health care.
Unfortunately, the provision of health facilities do not serve the whole society, whether poor or rich; and implementation of Jamkesmas health services is distorted-chaos, both at the provincial and district / city. “The poor does not have Jamkesmas card, while people who have good cell phone (handpone) actually have good Jamkesmas card. In a way, Jamkesmas is less successful, “said Senator of committee III House of Regional Representative (DPD) from North Sumatra, Darmayanti Lubis, at the interactive dialogue in DPD Pressroom, Parliament Complex, Senayan, Jakarta, Friday (13 / 5 / 11).
The event was titled Indonesian Perspectives “Questioning Jamkesmas in Region”. Aside from Darmayanti, the experts for the event are the member of Commission IX of the House of Representatives (DPR), the Indonesian Democratic Party of Struggle (PDI-P) Rieke Diah Pitaloka, Director of the Indonesian Health Consumer Empowerment Foundation Widjajarta Marius, and professor of the Faculty of Public Health University of Indonesia (FKM UI) Hasbullah Thabarany.
Based on the developments, he said, the Jamkesmas program is not fully failed, because there are points and the gaps that can be done to improve the implementation. “The most important thing for us, regional representatives, is in any government program, its implementation should not be centralized. In Jamkesmas, the implementation is completely centralized. DPD is hoping for attention,” continued Darmayanti.
In response to the attitude of the DPD, Hasbullah asserted, actually handed over the affairs of government including the regional center is a health service that is not an externality, or just a local impact. Therefore, health services through hospitals and clinics are decentralized but the finance is not decentralized since each region has a different capacity.
He proposed, “The government is paying dues. Thus, the central government with local governments who pay dues to BPJS (National Social Security Provider). In the future, there will be no welfare difference between the poor, the rich, who are paid by the region A, region B. All served the same, only the contributions that are different. “
Regarding its implementation, Rieke concluded, “Only in terms of data collection, Jamkesmas has failed.” Why? It is not comparable between the number of poor people who should be served in Jamkesmas and the amount of budget located in the Ministry of Health (Kemkes). For example, in 2008 the Central Statistics Agency (BPS) recorded the number of poor people approximately were about 36 million inhabitants, while the Ministry of Health (Kemkes) total budget was allocated for 76.4 million inhabitants. “Now is the year of 2011, but the government still uses the BPS of 2008.”
According to her, the social security system should not be regional. “No matter the pain, anytime, and anywhere, health care for the sick people should not be regional. This means that sick people should get health care. “Health insurance system also has to serve every person who entered their old age and children whose parents have passed away to be economically independent.
Considering the substance of Law 40/2004 which mandated the establishment of BPJS concerning basic rights of citizens, Rieke reminded that the discussion of draft Law (Bill) BPJS should not fail. If it fails, the government violates the Law 40/2004 and the 1945 Constitution. Consequently, the government does not only deal with DPD or DPR, but also the entire people of Indonesia. In fact, as an activist of Action Committee on Social Security, she threatened that the violation of the constitution could lead to impeachment.
