The Committee I Discussed the Regional Head Election Issues with the Minister of Home Affairs

 

The Committee I of the House of Regional Representatives questioned the performance of Minister of Home Affairs, Gamawan Fauzi on regional issues including the Draft Law of Local Government, Regional Head Election, Draft Law of DIY Privileges, and Single Identity Number. DPD RI asked the Minister of Home Affairs adding the requirements of regional head candidate and incumbent, in order to prevent the regional heads that has moral defect. The working meeting between Committee I and Minister of Home Affairs took place in GBHN room, the Parliament Complex in Senayan, Jakarta, Monday (17/01). It was chaired by the Chairman of Committee I of DPD Dani Anwar (senator of DPD from DKI Jakarta), accompanied by Vice-Chairman of Committee I of DPD Ferry FX Tinggogoy (senator of DPD from North Sulawesi) and Eni Khairani (senator of DPD from Bengkulu). The Vice-Chairman of DPD, La Ode Ida was also attending the working meeting. Meanwhile, Gamawan Fauzi was accompanied by the staffs of Ministry of Home Affairs.

On the occasion Laode Ida asked the Minister of Home Affairs to resolve the Draft Law on Local Government and the Draft Law on Regional Head Election as soon as possible, and made the grand design of the structuring of local government management, so that DPD could made the discussion agenda on the Draft Law. In addition, Laode Ida asked Home Minister reviewed the moral requirements of regional head candidate related to number of regional head cases who undergo the legal process because corruption case after inauguration. “We propose the clause for inclusion in the Draft Law on Regional Head Election as a filter. The mistake of political parties that nominated them (regional head candidate) is to ignore the issue and ethics, “he said.

According to Dani Anwar, DPD proposed two clauses requirements of regional head. First, firmly organizing the financial report of the regional head over the last two years was not in suspicious condition i.e. unqualified status (WTP).

Furthermore, in relation with moral requirements, Dani Anwar said that the regional head candidate over the past two years may not use social funds to private interests, including the campaign. “DPD is also considering the requirement for regional head candidates must not involve in legal proceedings, although in the early stages,” he explained.

Senator of Committee I of DPD, Tellie Gozelie (senator of DPD from Bangka Belitung) said, related to incumbent candidates, the government is needed to ensure the neutrality and independence of incumbent candidates. Starting from the registration, incumbent candidates must be in a period of leave. According to him it would prevent abuse of authority by the incumbent. The Draft Law on Regional Head Election should regulate the inclusion terms of incumbent achievement. In addition, it needed rules of incumbent assessment by the regional financial performance which viewed from the Supreme Audit Board report. “It is to prevent corruption and improve the accountability. Achievement appraisal can be seen one of them from the MDGs, “he explained.

Meanwhile, Gamawan revealed the number of regional heads whose became corruption case suspects. He was blatantly linking the corruption among local officials with the regional head election process that cost a lot of money. They did it for returning their investment. “Every week there are new suspects, 74 of them are the governor,” said Gamawan.

The gap between campaign fund of regional head election and salary of regional head made massive corruption.  “The money that is spent by governor candidates to campaign is about 60-100 billion Rupiahs. The fact is a governor in his tenure for five years at most can only collect of 6 billion Rupiahs, “said Gamawan.

Therefore, Gamawan said that the government and society should think more comprehensive. “When someone becomes regional head, he was required to apply clean government. But the campaign process when he would become a regional head was never highlighted,” he said.

Gamawan Fauzi said that his staffs are still working on to improve the regional head election legislation, including the moral requirements of regional head candidates. These requirements does not explicitly stipulated in Law No.32 of 2004. “In article 59, paragraph 4 of the Law, there is a stipulation that the political parties and the coalition of political parties in the determination of pairs of candidates, must consider the opinions and responses of society. Its purpose is to conduct the public test, “explained Gamawan.
