Does the Birth of the Bill on Prevention and Eradication is Appropriate?
The idea of Illegal Logging Bill has been going on for long. Behind the problem of illegal logging the basic problem is the issue of forest area and lack of comprehensive and inconsistencies in the law No.41 of 1999 on forestry.
In response to the Bill on the Prevention and Eradication of illegal logging, connected to the forests destruction, first is the issue of forest areas that are not resolved more important than illegal logging, second is the allocation injustice of forest benefits. “Not only illegal logging problem, but the use / utilization of forest area (permit/village/village) problem that has been happened,”
said Dr. Ir. Hariadi Kartodiharjo (forestry expert and lecturer of IPB), the RDPU of Committee II in Building B, DPD on the 3rd floor, Senayan, Jakarta, Wednesday (09/02/2011).
Regarding the forests in the Bill that is not included the meaning of the forest, sometimes we forget what the forest is? “Forests, as public goods, is the main function in the ecosystem because the balance component of the ecosystem, when the ecosystem is damaged the economy will also be damaged,” said Dr.Ir.Sofyan P. Warsito, forestry experts and lecturer of UGM.
The existence of controversy about whether the birth of this law is appropriate was responded by Intsiawaty Ayus, SH., MH (DPD Senator from Riau) quoted as saying “what is the value for the law to be born?” she said. Connected to it, Hariadi said that KP3L is a breakthrough in this bill which has tasks such as the KPK forestry, so that it is expected when this law is born there will be supervision.
The RDPU concluded that the Bill on Illegal Logging is seen as less urgent to be discussed because there is something more important to do which is making revision of Law No. 41 of 1999 on forestry because this eradication of illegal logging is part of the whole forestry. Structural institute in monitoring the field of forestry should be reviewed again by doing a revision of Law No. 41 of 1999 on Forestry, while the Bill on Combating Illegal Logging does not provide any legal certainty and Illegal Logging is not just talking about the wood they cut down illegally but also included in the part that has forest concessions (HPH) but doing the HPH does not conform with the permit allocation so that the definition of illegal logging needs to be clarified.
