Committee I Hearing on Village Bill
The 1945 Constitution firmly mandates that the village as an autonomous region (village autonomy) must be translated into other forms of legislation. This translation recognizes and respects the position of privilege, the original composition which was then called the village. Rural settings in a separate Act has been initiated through the Law No. 19 Year 1965 about the village territory of jurisdiction (Desapraja) and Law No. 5 Year 1979. Law No. 19 Year 1979 is not optimally implemented considering the political situation that heats up at the time. The effect of implementation of Law No. 5 Year 1979 with the nuance of village homogenety over 20 years could be resulted in the apathetic village life.
Amendment, carried by Law No. 22 Year 1999, did not get implemented because it was intervened by Kepmendagri No. 64 Year 1999. Apparently, the consistency of laws and regulations has not been maintained properly and this time it arises more thinking to formulate the Law of the village, according to Tumpal P. Saragih in his presentation in front of members of Committee I of DPD RI in the Public hearing that presents 3 (three) sources (Tumpal Saragih, M. Si, Henry Mampe Parulian Siahaan, SH, MM, Robert Endi Jaweng, M. Si) on Tuesday (25 / 1).
H. Amang Syafrudin, Lc (DPD Senator from West Java) responded, “Will this Village Bill be made separately (not bounded with the local government bill or others) or shall it bring forth a bill that became derivative of an Act?”.
Robert Endi Jaweng, who works on Regional Autonomy Implementation Monitoring Committee explained, “there are serious problems in the form and structure of village organizers which are charging provisions of Secretary Village (Sekdes) of civil service elements. Motivated to maintain neutrality and professionalism of Sekdes, this clause paved the way of village bureaucratization that had an impact in the form of state finance expansions, aside from raising the financial and functional jealousy, the village head office and other village officials also demanded the same status.
As an effort to strengthen the village autonomy in the future, it is important to build shared commitment for the restoration and development of village autonomy. The village social capital reinforcement is important to continuously cultivated. In addition, the expansion of the function or authority of the village and the institutional structure of village administration reinforcement are also two important dimensions that must be done immediately. With a strong village, either in terms of socio-cultural, economic or political, therefore, it will directly strengthen the region and ultimately strengthen the Indonesian nation, said Henry Mampe Parulian Siahaan at the end.
