The Bill of Oil and Gas are discussed in Public Hearing Meeting (RDPU) of Committee II DPD with PT. PERTAMINA
The RDPU of Committee II with President Director of PT. PERTAMINA (Persero); Ir. Swastioko Budhi Suryanto (Indonesia Oil and Gas Commission); Prof. Dr. Ir. Rudi Rubiandini RS (Academy of ITB) to discuss the list of Inventory Problems (DIM) Bill on Oil and Gas, preceded by an introduction as well as an opening of RDPU by the Chairman of Committee II DPD RI, Ir.H.Bambang Susilo, MM which then guided by the Team Work Chairman on the Bill of Oil and Gas, Intsiawati Ayus, SH., MH in committee II meeting room on the 3rd floor, Building B DPD RI, Senayan, Jakarta, Wednesday (20/10).
Pertamina that was represented by Adi Wibowo, Secretary of Pertamina Company and Irwan Priyaksa, Head of Corporate Legal Pertamina and its staff, in essence, give their views and suggestion that the Law No. 22 Year 2001 on Oil and Gas has not been fully internalized the Article 33 of the 1945 Constitution, for Pertamina contracts that will be expired is not automatically on Pertamina tender but still through the usual mechanism. Pertamina only has the right to propose to reopen the field for the production and the decision remains in the Government. Pertamina should be a Power House state but has not been given the rights as the national oil company, and there are still overlapping rules, for an example is the authority of oil and gas transportation is still ambiguous.
With the Law No. 22 of 2001, the position of Pertamina as the national oil and gas company is the same as other foreign companies contractors, for the proposal on Oil and Gas Bill, Pertamina proposed as quoted by Irwan “Pertamina wants the working areas that have an expired time period and the new open areas are given the first route, are given the option to manage those field ” he said. This is set on PP No. 35 year 2004 which was only limited to proposing.
Prof. Dr. Ir. Rudi Rubiandini RS provides much input for the Bill on oil and gas that Indonesia has many oil fields reserved and has been exploited, resulting in decreased reserves and energy supply will fall. In order to increase the oil field, it is necessary to hold the exploration but the reason is we do not have much money for exploration. “therefore, ITB proposes 4% of the funds should flow back into the cost of exploration and 1% for education” he asserted.
In respect of taxes imposed on oil and gas business proposed by the ITB that during the exploration it should be given special provisions, its tax payments if it gets results / production. With regard to this matter, Senator of DPD RI representatives from Maluku, Hj.Etha Hentihu Aisha asked, “Isn’t this will be potential for corruption and the mafia of tax, for the time, eventually the tax will get big?” She said. Meanwhile, The Professor explains that when talking about the form of contract, tax would be a problem in the event of contract work, and it should be applied to production sharing contracts, as stated by Professor “that the profit-sharing contract can still be applied, especially new concessions which we do not yet know how much is the cost” he explained.
On this Public Hearing Meeting of Committee II DPD RI, Chairman of the Team Work for Bills of Oil and Gas, Intsiawati Ayus SH., MH determined that Prof. Dr. Ir. Rudi Rubiandini RS is defined to be the Chairman of the Expert Team on Bills of Oil and Gas.
