Bill Privileges of Special District of Yogyakarta Province (RUUK DIY) should formalize the determination model of single dual of Sri Sultan Hamengku Buwono and Sri Paduka Paku Alam as the governor and vice governor of Special District of Yogyakarta (DIY). Determination model pairs of head and deputy head of local government of DIY Province through the Plenary Session of the Regional of Representative (DPRD) DIY submitted to the President for a decision ratified by President.

Thus the view that surfaced in the Public Hearing (RDPU) Committee I of the House of Regional Representatives (DPD) that attended the two vice-chairmen of the DPD, i.e. Gusti Kanjeng Ratu Hemas and Laode Ida, in Meeting Room of Committee I of DPD 2^nd floor, Parliament Complex, Senayan, Jakarta, Tuesday (2 / 3). The event which led by Chairman of Committee I of DPD Farouk Muhammad (West Nusa Tenggara) is also presenting Jawahir Thontowi, Director of Centre for Local Law Development Studies, Faculty of Law, Indonesian Islamic University (UII) Yogyakarta.

On the occasion, Hemas revealed the result meeting between Chairman and members of Commission I of the House of Representatives (DPR) with Sri Sultan Hamengkubuwono X, some time ago in Ngayogyakarta Hadiningrat Sultanate Palace. “Its direction is the determination,” he said, adding, final draft of RUUK DIY of DPD version formalizes the model election for governor and vice governor of DIY, but denied by the people of Yogyakarta.

Hemas told the development of DIY public opinion insisted that Sri Sultan Hamengkubuwono and Sri Paduka Paku Alam determined as governor and vice governor of DIY. The desire is expected to look for a constitutional solution, so that these aspiration suitable with Article 18 paragraph (4) of the 1945 Constitution or UUD 1945 which states the governor as the head of provincial local governments are democratically elected.

He/She deplores the delay of RUUK DIY discussion since submitted in 2002 to the House of Representatives. “But, the President does not anticipate it,” he said. Its non anticipation gave an impact on the development of public opinion in DIY, not only the communities who are long domiciled in DIY but also new community who domicile in DIY. “Last, there are political interests that enliven our nuance of democracy.”

After the wife of Yogyakarta Governor Sri Sultan Hamengkubuwono X talked, Laode take turn to express his views. He hoped that RUUK DIY ensure substance privileges of DIY that different with Law 11/2006 on Aceh Governance and Law 21/2001 on Special Autonomy for Papua Province. This substantive certainty is known by the people of Indonesia, not only people in the respective regions. “One of them are identifying the specialty of governance implementation in DIY”.

Specialty of governance implementation that referred is the position of Sri Sultan and Sri Paduka which set by DPRD DIY as governor and vice governor of DIY. “The desire of community for direct determination should be reviewed in order to avoid conflict with the 1945 Constitution,” he said, referring to the Article 18 paragraph (4) 1945 Constitution. As for the final draft of RUUK DIY of DPD version, it can be used as one reference.

Dani Anwar (Committee I of DPD senator from DKI Jakarta) said, whether democratic or not the election procedures for governor and deputy governor was not determined whether the assigned or chosen directly by the people. The determination is wisdom of DIY community which also realized democracy after internal Ngayogyakarta Hadiningrat Sultanate and the Puro Pakualaman Kadipaten selecting and Sri Sultan and Sri Paduka. “President SBY (Susilo Bambang Yudhoyono) must to be convinced that the determination does not conflict with the constitution.”

Anang Prihantoro (Lampung) also said the President must carry out the mandate of the Law if Plenary Meeting of the House of Representatives validating the RUUK DIY becomes UUK DIY which formalize duumvirate determination model of Sri Sultan  and Sri Paduka as governor and vice governor of DIY. “Determination is the portrait of democracy the community of Yogyakarta.”

Paulus Yohanes Sumino (Papua) strengthens Dani and Anang’s opinion. He reminds, “Keeping NKRI (the Unitary Republic of Indonesia) requires wisdom in creating future. If it all are generalized, we endanger the Unitary Republic of Indonesia. Do not make democracy as a magnificent creature. Democracy must be controlled. If the conditions of democracy are not accomplished, we will be a victim. Our morality is also become a victim.

In his presentation, Jawahir expose, the Bill on the Third Amendment of Law Number 3 Year 1950 about Formation of the Special Region of Yogyakarta, or RUUK DIY used as initiatives proposal of the House of Representatives. Options discussion of the proposal plus initiatives proposal of DPD will take time and cost. “There will be legal certainty for community of DIY, with a goverment tendency preserving diversity (asymetric approach) rather than uniformity (symetric approach).”

During the discussion of RUUK DIY, Asymetric approach include strengthening of substantive and peace democracy to the local harmony with bottom-up method that accommodate people’s sovereign power. Meanwhile, symetric approach follows the provisions of Law 22/1999 juncto Law 32/2004 on Regional Government in Article 24 paragraph (5) which states regional head and deputy head selected in one pair directly by the people in the region concerned.

He noted some of the substance in RUUK DIY settings, such as charismatic leaders Sri Sultan and Sri Paduka as governor (head region) and vice-governor (deputy head of region) DIY, special local regulation (perdais), land and spatial, budget allocation, including maintenance sultanate and the kadipaten, traditional institutions sultanate and kadipaten, as well as aspects of culture, education, tourism, and social tolerance.

Refinements of RUUK DIY is oriented to formalize the duumvirate leadership with determination model as governor and vice governor of DIY by Plenary Meeting of DPRD DIY which submitted to the President for authorized with presidential decision, extending the concept of origin and the heir to the duchy Sultanate, including daughter or other relatives.
